Seller means Divine Trash Limited, Registered in England under number 05688875 (Unit 5, The Cavendish Arcade, Buxton, Derbyshire, SK17 6BQ, United Kingdom) and the company's website www.divinetrash.co.uk. Our VAT registration number is GB 881 4946 85.
Customer means the person or company to whom this document is addressed.
These terms and conditions are applicable to the supply of products made by the Seller, hereafter referred as Divine Trash, to the buyer hereafter referred to as the Customer.
2.1 All prices are quoted in British Sterling unless otherwise specified and are inclusive of 20% VAT (IF APPLICABLE) (as may be prescribed by law from time to time) unless otherwise specified.
2.2 All prices are inclusive of postage and packing in the UK unless the order comes to less then £25 and then a standard rate of £2.95 will apply. Special Delivery is also available at a premium.
3.1 Payments must be made in British Sterling unless otherwise specified, and by one of the following payment methods
· Major credit cards and debit card payments via SagePay (including Visa Delta, Mastercard, Maestro & Visa Electron)
4. PASSING OF PROPERTY
Divine Trash shall retain the property of the goods until full payment has been made by the customer and has been received
5. PASSING OF RISK
The risk in the goods shall pass to the customer on delivery, as defined in clause 6.3 below.
6.1 Delivery dates:
Any date or period for delivery shall be considered indicative only, although it is our policy to try to despatch all orders within 1 working day. Any products not available at the time of your order will be sent to you, as soon as possible, when received from the manufacturer. Divine Trash cannot be held responsible for delays in the delivery caused by the manufacturer, or any other third party. You will however be fully notified of any delays.
Divine Trash ships to many international locations.
Orders will be shipped via Recorded Delivery or Standard First Class, Royal Mail Service or International Signed For services. Divine Trash has the right to fluctuate these prices in proportion to their costs for shipping. In the event of goods being lost or damaged in the post, Divine Trash will claim from Royal Mail.
6.3 PASSING OF RISK
Divine Trash bears no risk once the package has been received by the consumer. Where the goods are signed for, the customer bears the risk. If a customer believes that a parcel has been tampered with, it is their responsibility to refuse to sign for the goods. It is the responsibility of the customer to supply a safe address to deliver the parcel, as once a parcel becomes in receipt of a signature, Divine Trash will bear no liability.
This is not a guarantee and Divine Trash have the right to refuse any application. Any refund/exchange given is at the discretion of the management of Divine Trash. Failure to give accurate information while making a claim may lead to prosecution from Royal Mail.
7. E-TAIL OF PRODUCTS
By making a request/order you are offering to purchase a product which we will accept to sell to you on the following Terms and Conditions. All requests are subject to availability and confirmation of the order price by us. Dispatch times may vary according to availability and any guarantees warranties or representations made as to delivery times are limited to mainland UK and are on the basis that we are not responsible for any delay in delivery occurring due to postal delays or force majeure. If your order is accepted we will inform you by emailing you. When making a request you undertake that all details you provide to us requesting goods or services or bids made at auction are true and accurate, that you are an authorised user of the credit or debit card used to make your request or bid and that there are sufficient funds to cover the cost of the goods, services or bid. You are responsible for informing us of any changes to these details as soon as possible. The cost of foreign products and services may fluctuate. All prices advertised are subject to such changes.
All orders received via divinetrash.co.uk will immediately result in an email receipt being sent to the customer. If the customer creates an online account on divinetrash.co.uk, access to all orders (and their status) will also be available.
8. RETURNS PROCEDURE
The customer has the right to cancel their purchase within 14 days following the delivery of their order. Cancellation requests must be by email to [email protected].
The customer shall inspect the goods within a reasonable time after their receipt and shall be deemed to have accepted the goods unless within 14 days after their receipt the customer shall have notified the seller that the goods are rejected.
We do not offer free returns on item/s. We are unable to offer free returns for our International customers and the return postage for overseas orders is the responsibility of the customer Divine Trash will not accept liability for any items sent without a certificate of postage.
8.1 The customer must send all unsuitable items to ;
Returns Dept, Divine Trash, Unit 5, The Cavendish Arcade, Buxton, Derbyshire SK17 6BQ.
If you require a refund/exchange, please ensure all the original tags and labels are still attached and the item(s) are in the original packaging. It is advisable that a certificate of posting is obtained.
8.2 In cases where the rejection of the goods is due to a defect or discrepancy in the order, the customer is entitled to a full refund or replacement. The faulty or damaged product must be returned to Divine Trash before a refund or replacement can be issued.
8.3 In cases where the customer does not sign for the goods on delivery or for whatever reason, they are not accepted by the customer and returned, we will offer either to re-send the package (which will incur the original shipping charges again) or to refund the original payment.
8.4 If a promotional offer is active at the time of placing your order, we do ask that if you wish to return the goods, please ensure you enclose the promotional item along with the unsuitable garment/s for a full refund. If you choose not to return the promotional item this will then be deducted from the refund amount.

11. LICENCE AGREEMENT
The customer shall respect all licence agreements delivered by the copyright owners. Divine Trash cannot be held responsible or liable for any misuse conducted by the customer or any third party. All trademarks shown on www.divinetrash.co.uk belong to their registered owners and must not be copied without prior permission.
These terms and conditions are governed and shall be interpreted in accordance with English Law. Any person attempting to make fraudulent credit card transactions will be prosecuted with no exception.

If you are not entirely satisfied with your order and would like a replacement size/colour please email [email protected] and advise us of your requirement. This then enables us to reserve the garment for you. As soon as the original item/s are received back then the replacement item/s will be dispatched. Exchanges are free of charge in the UK, overseas orders will incur their original postage costs.

Faulty or Incorrect Goods
Your delivery charge may be refunded in some circumstances. For example: if your entire order was faulty or incorrect. Please note that this refund policy only applies to orders placed directly through our website or customer service, and not through third-party platforms.
To request a refund for your delivery charge, please contact our customer support team [email protected] before dispatch to ensure that a refund agreement is made prior to returning the item just to avoid confusion or disappointment. Once this agreement has been made we can then supply a pre-paid postage label for the goods.

UK AND NORTHERN IRELAND ORDERS:
Your order will be dispatched using either Royal Mail First Class Recorded Delivery, Royal Mail Special Delivery or by courier depending on weight and size.
Before completing your preferred delivery address, please make sure that someone will be there to sign for the package.
Royal Mail or the courier will attempt to deliver the package once, if you then require a re-delivery this is the responsibility of the customer to arrange.
Delivery is FREE for all UK orders.
Stock orders made between Monday to Friday before 4 pm are 99% of the time dispatched the very same day.
Stock orders made after 4 pm and at weekends/bank holidays may take a day or two longer to arrive. Stock availability may also delay some deliveries.
Delivery is a standard fee of £8.95 for all European orders (delivery within 3-5 working days).

We will ask you to register with us informing us of the address your card is registered to and where you want your order delivered, if different. This will then allow you to choose a password to create a personal account which you can view every time you shop with us. Payment will only be taken when your order is placed, we will then email you to confirm the order.
