Definitions
Seller means Divine Trash Limited (Unit 5, The Cavendish Arcade, Buxton, Derbyshire, SK17 6BQ, United Kingdom) and the company's website www.divinetrash.co.uk.
Customer means the person or company to whom this document is addressed.
1. GENERAL
These terms and conditions are applicable to the supply of products made by the Seller, hereafter referred as Divine Trash, to the buyer hereafter referred as the Customer.
2. PRICE
2.1 All prices are quoted in British Sterling unless otherwise specified and are inclusive of 20% VAT (IF APPLICABLE) (as may be prescribed by law from time to time), unless otherwise specified.
2.2 All prices are inclusive of postage and packing in the UK, unless the order comes to less then £25 and then a standard rate of £2.95 will apply. Special Delivery is also available at a premium.
3. PAYMENT
3.1 Payments must be made in British Sterling unless otherwise specified, and by one of the following payment methods
· Major credit cards as listed: Visa, MasterCard, Delta, American Express, Switch and Visa Electron
· PayPal
· Cheques made payable to Divine Trash Limited.
· Postal orders made payable to Divine Trash Limited.
4. PASSING OF PROPERTY
Divine Trash shall retain the property of the goods until full payment has been made by the customer and has been received
5. PASSING OF RISK
The risk in the goods shall pass to the customer on delivery, as defined in clause 6.3 below.
6. DELIVERY
6.1 Delivery dates:
Any date or period for delivery shall be considered as indicative only, although it is our policy to try to despatch all orders within 1-2 working days. Any products not available at the time of your order will be sent to you, as soon as possible, when received from the manufacturer. Divine Trash cannot be held responsible for delays in the delivery caused by the manufacturer, or any other third party. You will however be fully notified of any delays.
6.2 SHIPPING
Divine Trash ships to many international locations.
Orders will be shipped via Recorded Delivery or Standard First Class, Royal Mail Service or International Signed For services. Most packages arrive within 1 business day within the UK. Divine Trash have the right to fluctuate these prices in proportion with their costs for shipping. In the event of goods being lost or damaged in the post, Divine Trash will claim from Royal Mail.
6.3 PASSING OF RISK
Divine Trash bears no risk once the package has been received by the consumer. Where the goods are signed for, the customer bears the risk. If a customer believes that a parcel has been tampered with, it is their responsibility to refuse to sign for the goods.
This is not a guarantee and Divine Trash have the right to refuse any application. Any refund/exchange given is at the discretion of the management of Divine Trash. Failure to give accurate information while making a claim may lead to a prosecution from Royal Mail.
7. RETURNS PROCEDURE
The customer has 1 working day to cancel any orders and 14 working days to notify and return the goods purchased. Cancellation requests must be either by email to cancellations@divinetrash.co.uk or by telephone on 0845 805 4706.
The customer shall inspect the goods within a reasonable time after their receipt and shall be deemed to have accepted the goods unless within 7 days after their receipt the customer shall have notified the seller that the goods are rejected.
7.1 If the goods are to be rejected in the time limit set above, the customer shall comply with the return procedure as defined in clause 7.2, below. Divine Trash will not accept any returned goods should the return not follow the aforementioned returns procedure.
7.2 The customer must send all unsuitable items within 14 days to ;
Returns Dept, Divine Trash, Unit 5, The Cavendish Arcade, Buxton, Derbyshire SK17 6BQ.
If you require a refund/exchange, please ensure all the original tags and labels are still attached and the item(s) are in the original packaging. It is advisable that a certificate of posting is obtained. All items must be returned with 14 days of receipt.
7.3 In cases where the rejection of the goods is due to a defect or discrepancy in the order, the customer is entitled to a full refund or replacement. The faulty or damaged product must be returned to Divine Trash before the refund or replacement can be issued.
7.4 In cases where the customer does not sign for the goods on delivery or for whatever reason, they are not accepted by the customer and returned, we will offer either to re-send the package (which will incur the original shipping charges again), or to refund the original payment.
7.5 If a promotional offer is active at the time of placing your order, we do ask that if you wish to return the goods, please ensure you enclose the promotional item along with the unsuitable garment/s for a full refund. If you choose not to return the promotional item this will then be deducted from the refund amount.
8. CANCELLATIONS
8.1 Cancellations can be made via Divine Trash’s cancellations email address cancellations@divinetrash.co.uk .
9. PRIVACY POLICY
Any information passed through to divinetrash.co.uk is via a secure connection on the internet using Secure Socket Layer technology at 128bit encryption (where browsers will allow). If a customer wishes for their information to be removed from our database, this should be requested in writing at our registered office (please see below) or to info@divinetrash.co.uk.
Please note, credit card details are not retained. The only information stored is a customer's transaction history, name, address & e-mail address. These may be used for marketing purposes by Divine Trash or any associated companies. Customers will not be sent 'spam' e-mail. Should any customer not want their details used for marketing purposes, please tick the relevant box at the checkout or request to be removed at info@divinetrash.co.uk.
10. LICENCE AGREEMENT
The customer shall respect all licence agreements delivered by the copyright owners. Divine Trash cannot be held responsible or liable for any misuses conducted by the customer or any third party. All trademarks shown on www.divinetrash.co.uk belong to their registered owners and must not be copied without prior permission.
11. LAW
These terms and conditions are governed and shall be interpreted in accordance with English Law. Any person attempting to make fraudulent credit card transactions will be prosecuted with no exception.

Exchanges
If you are not entirely satisfied with your order and would like a replacement size/colour please email sales@divinetrash.co.uk and advise us of your requirement. This then enables us to reserve the garment for you. As soon as the original item/s are received back then the replacement item/s will be dispatched. Exchanges are free of charge in the UK, overseas orders will incur their original postage costs.

Delivery
UK AND NORTHERN IRELAND ORDERS:
Your order will be dispatched using either Royal Mail First Class Recorded Delivery, Royal Mail Special Delivery or by courier depending on weight and size.
Before completing your preferred delivery address, please make sure that someone will be there to sign for the package.
Royal Mail or the courier will attempt to deliver the package once, if you then require a re-delivery this is the responsibility of the customer to arrange.
Delivery is FREE for all UK orders of £25 or above and a standard fee of £2.95 will apply to all UK orders below this amount.
Stock orders made between Monday to Friday before 4pm are 99% of the time dispatched the very same day.
Stock orders made after 4pm and at weekends/bank holidays may take a day or two longer to arrive. Stock availablilty may also delay some deliveries.
We aim to deliver within 1-3 working days of your order being placed.
Delivery is a standard fee of £5.95 for all European orders (delivery within 3-5 working days).
Delivery is a standard fee of £9.95 for all WORLDWIDE (other than european) orders (delivery within 5-10 working days).

Payment options
We will ask you to register with us informing us of the address your card is registered to and where you want your order delivered, if different. This will then allow you to choose a password creating a personal account which you can view every time you shop with us. Payment will only be taken when your order is placed, we will then email you to confirm the order.
We accept secure online payments from all major debit and credit cards. A highly secure service is provided where your details are not held on our database.

Discount Coupons
If you didn't enter your discount code at the checkout, I am afraid we can't apply it to that order or amend your payment in any way.
If a discount code was applied to your original order, the refunded amount will be adjusted to reflect this.
